Terms of Service

These terms govern the BuildForFree website and program ("we", "us"). By using the site or submitting an application you agree to them. If you apply on behalf of an organization, you confirm you are authorised to bind it, and "you" means that organization as well.

1. What the program is

Each month we select at most one applicant and build them a working web application for a single workflow, at no charge, in exchange for the rights described in section 5. Selection is entirely at our discretion. Applying does not create any obligation on us to select you, to respond, or to build anything, and we may pause or end the program at any time.

We may decline any application for any reason, including because it is vague, oversized, a hobby idea, requires payments, regulated data (such as HIPAA or similar), or a multi-sided marketplace, or because we do not have capacity.

2. Your application

You confirm that what you submit is accurate, that you have the right to share it, and that it contains no confidential information you are not permitted to disclose. Do not include passwords, personal data about third parties, or anything you would not want us to read. Automated, bulk or fraudulent submissions are prohibited and may be discarded silently.

3. If you are selected

A selected project proceeds only once we have agreed the scope in writing (email is sufficient) and you have provided the access, sample data and a named decision-maker we need. You agree that the decision-maker will respond to our questions within forty-eight hours during the build. If access or answers are not provided, the fourteen-day period pauses, and we may withdraw from the project.

We choose the technology and the scope. Our goal is a hosted MVP you can use as-is for the workflow described in your application. It is not a specification-driven custom build, ongoing development, or a commitment to any feature not in the agreed scope.

Timelines are targets, not guarantees. "Fourteen days" is our intent under normal conditions and may be extended for reasons on either side.

4. Ownership

You own the application we build for you, including its source code, once the project is delivered, subject to these terms. Third-party and open-source components remain under their own licences. We keep the right to reuse general know-how, techniques, and non-identifying code patterns in other work, and we keep ownership of anything we developed before or independently of your project.

You grant us a licence to use your application and its data only as needed to build, test, deliver and support it, and to produce the materials in section 5.

You will have the chance to review the case study for factual accuracy and to flag genuinely confidential details before publication. This licence is worldwide, royalty-free and continues after the project ends; we will honour a reasonable request to remove the materials if your organization changes materially (for example ceases to exist), but need not remove copies already distributed.

6. Hosting and after delivery

Hosting is yours from day one. Our work is free; running the application is not our cost to carry. Wherever practical we build directly in accounts you own (hosting, domain, database, third-party services), and you are responsible for those accounts and any fees they incur — most small internal tools fit within providers' free tiers, but that is between you and the provider.

If we temporarily use our own accounts during the build, we will hand everything over at delivery, and you agree to complete the transfer (create the accounts, accept the transfers, update billing) within fourteen days of delivery. After that we may shut down anything still running on our accounts without further notice. Delivery — not handover — is when the project is complete.

We are not responsible for hosting, uptime, backups, maintenance or support after delivery unless we separately agree to provide them on paid terms.

7. No warranty

The program is free. The website and any application we build are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, security, accuracy, or uninterrupted operation. You are responsible for deciding whether the application is suitable for your use, for your data, for compliance with laws that apply to your organization, and for any decisions made using it.

8. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, revenue or business, arising from the site, the program, or any application we build, however caused. Our total liability for all claims relating to the program will not exceed one hundred US dollars (US$100) — reflecting that no fee was paid. Nothing in these terms limits liability that cannot be limited by law.

9. Indemnity

You will indemnify us against claims arising from your data, your use of the application, your breach of these terms, or your infringement of anyone's rights, including any claim that materials you gave us for the build were not yours to share.

10. Using the website

You may not attempt to disrupt the site, probe or bypass its abuse controls, submit automated traffic, or use it for anything unlawful. The site's content is ours and may not be copied for commercial use without permission.

11. Privacy

How we handle your information is described in the Privacy Policy, which forms part of these terms.

12. General

These terms are the entire agreement about the website and the program unless we sign a separate written agreement for a selected project, in which case that agreement prevails where it conflicts. If part of these terms is unenforceable the rest still applies. Our failing to enforce a term is not a waiver. We may update these terms by posting a new version here; the version in force when you applied governs your application, and material changes to a selected project will be agreed with you.

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Florida. Where your local law gives you non-waivable consumer protections, those still apply.
